James and Ashley Roeder went on trial last friday for the burglary of a Jefferson County warehouse in Kentucky. Ashley Roeder was pregnant at the time but they were both incarcerated separately for the incident causing James to miss the birth of his child. One month later, Judge Amber Wolf was wrapping up James’s hearing and preparing to preside over Ashley Roeder’s case when she saw the new mother holding her baby.

“I saw [Ashley] try to hold the baby up when [James] came out for his case to be called with his attorney,” Judge Wolf told the local news on Monday.

Wolf saw that James didn’t notice his wife’s attempt at getting his attention. Then a realization finally clicked in the judge’s mind.

“It occurred to me after we finished this case that he had not met his baby — who was 30 days old — and that he was not going to get an opportunity to meet his baby anytime in the near future.”

In that moment, Judge Wolf had a change of heart and decided to give him the chance to meet his newborn son. She asked Ashley if the father could hold the child, who tearfully said ‘yes.’
